TERMS OF SERVICE OF THE SOCIALMAMA MOBILE APPLICATION

1. Who these Terms of Service are for
1.1. These Terms of Service govern the relationship between:
Lazy Mama Ltd., entered in the Commercial Register and the Register of Non-Profit Legal Entities kept by the Registry Agency of the Republic of Bulgaria under UIC: 208288161, with its registered seat and management address at: Sofia (1715), Studentski district, 102A Nikola Gabrovski Street, floor 5, apt. 9, and correspondence address at: Sofia (1715), Studentski district, 102A Nikola Gabrovski Street, floor 5, apt. 9, represented by Delyana Ivanova Samolova, VAT registration: BG208288161, contact email: info@socialmama.app, referred to below as “Lazy Mama”, “SocialMama”, “we” or “the Provider”,
and every adult person who creates a profile or uses the SocialMama mobile application, referred to below as “you” or “the user”.
1.2. In these Terms of Service we mainly use the feminine gender, because SocialMama was created for mothers and pregnant women. This does not change the legal effect of the document in relation to any adult person who uses the application.
1.3. SocialMama is a mobile application for iOS and Android that helps mothers and pregnant women find other mothers nearby and at a similar stage of parenthood.
1.4. These Terms of Service are a contract between you and Lazy Mama Ltd. for the use of SocialMama.
2. Documents that apply to SocialMama
2.1. The following documents apply to your use of SocialMama:
- These Terms of Service;
- The Community Guidelines;
- The Privacy, Cookies and Technologies Policy;
- Additional terms for promotions, prize games, campaigns or paid features, if any are introduced.
2.2. The Community Guidelines form an integral part of these Terms of Service. When you accept the Terms of Service, you also accept the Community Guidelines.
2.3. The Community Guidelines govern the rules of conduct within the application, including posts, chats, reporting, blocking, moderation, prohibited content and measures in the event of breaches.
2.4. The Privacy, Cookies and Technologies Policy explains how we process your personal data and how we use technologies to store or access information on your device, where applicable. It is a separate informational document. Accepting these Terms of Service does not constitute general consent to all processing of personal data.
2.5. Where separate consent is required for a particular processing operation — for example for marketing, analytics or otherwise — we will ask you for separate and clear consent.
3. What SocialMama is
3.1. SocialMama is a social platform for mothers and pregnant women. Its purpose is to reduce maternal isolation by helping users find other mothers nearby and at a similar stage of parenthood.
3.2. SocialMama’s core features include:
- a profile with a name, photo, short description, approximate age of your child/children and availability status;
- the ordering of profiles according to approximate location and parenting stage;
- location, used to search for mothers around the place where you are;
- the “Finder” — a directory of profiles of mothers nearby;
- 1:1 chat between users;
- “Community Buzz” — a community wall for posts, questions, answers and reactions;
- “Current Status” — a social indicator of whether you are open to contact or to meeting;
- push notifications, if you enable them;
- privacy settings and consent management.
3.3. SocialMama is not a medical, psychological, advisory, emergency or professional health service. The content on SocialMama does not replace consultation with a doctor, midwife, psychologist or other specialist. If you have a medical question, an emergency, or a risk to yourself or to a child, you must contact the relevant specialist or competent authority. SocialMama is not intended for emergency assistance.
3.4. SocialMama is not a medical device within the meaning of the Medical Devices Act or the relevant European legislation.
4. Who may use SocialMama
4.1. SocialMama may be used only by persons who have reached the age of 18 and who are about to acquire, or already hold, the legal status of “Parent” (mother, foster mother, adoptive parent and/or female guardian, transgender women).
4.2. By creating a profile, you confirm that:
- you are 18 years of age or older;
- you provide true and up-to-date information;
- you are creating the profile in your own name;
- you will not impersonate another person;
- you will not use another person's identity, photo or data;
- you will comply with these Terms of Service and the Community Guidelines.
4.3. Children may not create profiles on SocialMama.
4.4. If we learn that a profile has been created by a person under the age of 18, we may delete or restrict it without notice.
5. Information about children provided by the Parent
5.1. SocialMama is not an application for children and is not offered directly to children.
5.2. The application may allow a user to enter limited information about her child or children, in order to be matched with Parents at a similar parenting stage.
5.3. This information may include: the approximate age of the child; optionally, the child’s sex; the number of children; other minimal information, where necessary for the feature and indicated in the application.
5.4. SocialMama does not require: a child’s name; a child’s national identity number (EGN); an exact date of birth; a child’s medical records; a child’s diagnoses or health data; a photo or video of a child to confirm parenthood, nor in any other case.
5.5. You confirm that you are entitled to provide the information about your child/children.
5.6. You must not provide data about other people’s children unless you are entitled to do so.
5.7. You must not publish photographs, medical records, personal data or sensitive information about other people’s children.
6. Pregnancy and parenting-stage information
6.1. SocialMama requires, as a mandatory condition, that a user be a current or expectant Parent in order to register and use the application’s features. You may enter information about the month of your pregnancy and/or the age of your children. The information under this section is a mandatory condition for registration and use of the application; the reasons for, and the means of, processing and storing this data are described in detail in the Privacy, Cookies and Technologies Policy.
6.2. This information is used to show you other Parents at a similar stage, to the extent that this feature is available.
6.3. Pregnancy information may constitute sensitive information about health.
6.4. You may change or remove the information you have entered from your profile at any time.
6.5. By providing specific data, you declare that it is accurate and you bear responsibility in accordance with these Terms of Service, the Privacy, Cookies and Technologies Policy and the Community Guidelines. We reserve the right to remove users where we have sufficient grounds to believe that they have acted abusively by providing false information.
7. Registration and sign-in
7.1. To use SocialMama, you must create a profile.
7.2. You may register or sign in via:
- Apple;
- Google;
- an email address and a one-time access code.
7.3. When signing in by email, you will receive a one-time confirmation code, which you must enter in the application in order to complete the registration of your user profile.
7.4. You are responsible for access to your email, your device and your profile.
7.5. If you believe that someone has gained unauthorised access to your profile, you must notify us at info@socialmama.app.
8. Electronic conclusion of the contract
8.1. The contract for the use of SocialMama is concluded electronically and is deemed concluded upon completion of the registration of your profile.
8.2. Before you create a profile, you will be given access to: the Terms of Service; the Community Guidelines; the Privacy, Cookies and Technologies Policy; and information about Lazy Mama Ltd. as the provider of the service.
8.3. The contract is concluded through the following steps:
- you open the application;
- you are given access to the legal documents;
- you tick or activate a box/slider by which you accept the Terms of Service and the Community Guidelines;
- you confirm that you have read and accept the Privacy, Cookies and Technologies Policy;
- you choose a registration or sign-in method;
- you confirm sign-in via Apple, Google or an email code;
- a user profile is created.
8.4. By the actions:
“I agree to the Terms of Service and the Community Guidelines”
“I accept and agree to the Privacy Policy”
you make an electronic statement that you accept the contract for the use of SocialMama.
8.5. The system may store evidence of your acceptance, including: an anonymous identifier of the accepting person; the user’s email address; the date and time on which the registration process was started; the completion of registration; the acceptance of, and consent to, each document (Terms of Service and Community Guidelines; Privacy, Cookies and Technologies Policy); the type, version and language of the document (Terms of Service; Community Guidelines; Privacy, Cookies and Technologies Policy); the registration method under these Terms of Service; technical logs necessary to evidence the action: the operating system used; confirmation of access from a mobile device, and the make and model of the device.
8.6. After registration we send you a confirmation by email or in the application that you have created a profile and have accepted the relevant version of the documents in force at the time this contract was concluded.
9. Access to the documents
9.1. The Terms of Service, the Community Guidelines, the Privacy, Cookies and Technologies Policy and the other applicable documents are accessible:
- before registration;
- at any time in the application, from the menu:
- for the Community Guidelines: Profile → Settings → Community Guidelines;
- for the Terms of Service: Profile → Settings → Privacy → Terms of Service;
- for the Privacy, Cookies and Technologies Policy: Profile → Settings → Privacy → Privacy Policy.
- at a permanent public address: https://www.socialmama.app/legal
- through links in the App Store / Google Play, where applicable.
9.2. The documents are stored and can be reproduced at any time. We will maintain versions of the documents and will state the effective date. In the event of a material change, we will notify you in an appropriate manner.
10. Correcting errors
10.1. Before you complete registration, you can correct the information you have entered using the buttons and screens available in the application.
10.2. After registration you can change your profile information, other than your email, from your profile or your settings.
10.3. For certain actions we may require additional confirmation, for example: changing your email; deleting your account; restoring access; requesting a download of your data; security-related actions.
11. Language
11.1. SocialMama may be accessed in Bulgarian and in English.
11.2. For users in Bulgaria, the Bulgarian version of the Terms of Service prevails in the event of a conflict between the language versions.
11.3. Acceptance of the Terms of Service is recorded together with the language version that was displayed to the user.
12. Profile and profile photo
12.1. SocialMama was created as a community for trusted contact between Parents. A profile photo helps users see who they are communicating with and is important for safety, trust and limiting fake profiles. Accordingly, a profile photo is necessary for full use of SocialMama. If you do not upload a profile photo, you will not be granted access to the application.
12.2. You must not upload (this is prohibited): a photo of another person; a photo to which you do not hold the rights; a misleading photo; a photo with children as the main focus, where this is not appropriate; sexual, offensive, threatening or unlawful content.
12.3. The profile photo is not used for facial recognition, biometric identification or automated identity verification, unless we introduce such a feature in the future following separate notice and after obtaining the necessary consents.
13. Future verification and biometric data
13.1. In a future version, SocialMama may introduce additional profile verification, including by means of a selfie or an external provider.
13.2. If such a feature involves facial recognition, facial comparison, a liveness check or other biometric processing, it will be introduced only after: clear prior information; separate explicit consent, where the law requires it; a description in the Privacy, Cookies and Technologies Policy; appropriate security measures; and the availability of an alternative procedure, where this is necessary to ensure freedom of choice.
13.3. Verification features may never be used for marketing, advertising or other incompatible purposes without a separate legal basis.
14. Location
14.1. Location is a core part of SocialMama, because the application helps you find mothers nearby. Sharing your location is a mandatory requirement for using the application, and we offer different ways of doing so: (1) granting access to the device’s location; (2) manually entering an address or area; (3) another feature, if added.
14.2. When you grant GPS access, the device may provide exact coordinates. SocialMama uses them momentarily in order to calculate an approximate area. The exact coordinates remain on your device and are not stored or processed any further.
14.3. SocialMama does not store or display your exact GPS location under any circumstances. Further information on the grounds, methods, technologies, legal bases and retention periods can be found in the Privacy, Cookies and Technologies Policy.
14.4. You must not publish your exact home address in your bio, in posts or in chats.
15. “Current Status”
15.1. “Current Status” is a social signal of availability.
15.2. A “Current Status” shown in green (“Available for walks”) means that you are open to contact or to meeting another user.
15.3. A “Current Status” shown in red (“Just browsing”) means that you would prefer not to be approached or disturbed by other users.
15.4. “Current Status” does not mean that you are sharing your current location.
15.5. “Current Status” does not display an exact address, GPS coordinates or movement.
16. Chat
16.1. SocialMama may provide 1:1 chat between users, and it is intended for respectful personal communication between users. The chat supports text and voice messages, as well as photographs.
16.2. You are prohibited from sending via chat: threats; harassment; sexual propositions or sexual content; insults; spam; fraud; requests for money; third parties’ personal data; content that breaches the Community Guidelines.
16.3. SocialMama may store technical data necessary for the operation of the chat, for example conversation identifiers, participants, timestamps and delivery status. Full information is set out in the Privacy, Cookies and Technologies Policy.
16.4. If you report a chat and send a screenshot, text, voice message or description of the conversation, the content you provide will be reviewed by the SocialMama team for moderation and safety purposes.
17. “Community Buzz” and user content
17.1. “Community Buzz” is a community wall for posts, questions, answers, reactions and sharing experiences. Posts in “Community Buzz” are visible to other users. You are responsible for the content you publish.
17.2. You must not publish: medical records; diagnoses; national identity numbers (EGN); exact addresses; third parties’ telephone numbers; photographs of other people’s children without permission; photographs of other users without permission; content that discloses other people’s personal data; offensive, discriminatory or threatening content; sexual content; content that encourages self-harm or violence; fraud, fake campaigns or misleading listings; medical misinformation; content that breaches the law or the rights of third parties.
17.3. Detailed content rules are set out in the Community Guidelines.
17.4. SocialMama may remove, hide or restrict content that breaches these Terms of Service, the Community Guidelines or the law.
18. Community Guidelines
18.1. The Community Guidelines were created to keep SocialMama a safe, respectful and useful space. They form an inseparable part of these Terms of Service. A breach of the Community Guidelines is a breach of these Terms of Service.
18.2. The Community Guidelines contain rules on: respectful communication; the prohibition of harassment; the prohibition of discrimination; the prohibition of sexual content; the prohibition of fraud; the prohibition of spam; the protection of children; photographs and personal data; medical content; reporting; blocking; moderation; sanctions.
18.4. We may update the Community Guidelines separately from the Terms of Service, where this is necessary for safety, moderation, content rules or the functioning of the community. In the event of a material change, we will notify you in an appropriate manner.
19. Reporting, blocking and moderation
19.1. SocialMama provides mechanisms for reporting:
- profiles (including the profile photos);
- posts;
- answers to posts;
- users in connection with a chat.
19.2. You may block another user when you do not wish to communicate with her. Once blocked, the other user may be prevented from messaging you or interacting with you, according to the technical capabilities of the application.
19.3. Reports are reviewed by the SocialMama team or by persons to whom SocialMama has assigned this activity, in clear compliance with the documents you have accepted. When a report is made, we process the data set out in the Privacy, Cookies and Technologies Policy.
19.4. We may take one or more of the following measures: no action, where the report is unfounded; a warning; hiding content (a post or an answer); restricting the ability to send private messages to another user following blocking; temporarily restricting a profile in accordance with the Community Guidelines; suspending a profile pending a decision by a SocialMama administrator to restore access and lift the restriction; permanently terminating a profile and blocking re-registration in the case of a serious breach of the Community Guidelines; notifying a competent authority, where this is necessary or required. In the case of serious breaches, we may act without prior warning. Serious breaches are those expressly identified in the Community Guidelines.
19.5. We may inform the reported user of a measure taken, but we will not disclose the identity of the reporting user where this could endanger her safety or rights.
19.6. If your profile is restricted or terminated, you may submit an objection to info@socialmama.app. We will review the objection within a reasonable period, having regard to the complexity and risk of the case.
19.7. SocialMama may use automated means to detect content that breaches these Terms of Service or the Community Guidelines. Decisions with a significant effect are subject to human review and may be appealed in accordance with sections 25 and 26 of the Community Guidelines.
20. Safety at in-person meetings
20.1. SocialMama facilitates contact between users, but does not organise, supervise, vet or guarantee in-person meetings outside the application. You alone decide whether, when and where to meet another user.
20.2. SocialMama is not liable for the actions of users outside the application, except where the law provides otherwise. For your own safety, we recommend that: first meetings take place in public places; you do not share your exact home address; you tell someone close to you where you are going; you do not leave your child with a person you do not know; you end contact if you suspect a risk; and you use the reporting function in the event of concerning behaviour.
21. Medical content
21.1. SocialMama does not provide medical services.
21.2. Users likewise must not present posts, answers or messages as a medical diagnosis, treatment or professional advice, unless they are entitled to provide such a service and this is clearly indicated.
21.3. Even where a user is a medical professional, content on SocialMama does not replace an individual medical consultation.
21.4. Publishing medical misinformation that may harm mothers, pregnant women or children is prohibited.
21.5. We may remove medical content that we consider risky, misleading or unsuitable for the community.
22. Push notifications
22.1. SocialMama may send push notifications if you have enabled them in your device settings. They may be: service-related; profile-related; security-related; chat-related; or related to activity in the application.
22.2. You can manage push notifications from your device settings.
22.3. Push notifications are not a condition for using SocialMama’s core features.
22.4. You must not rely on push notifications in emergency situations.
23. Service and transactional messages
23.1. We may send you service messages necessary for the use of SocialMama, including:
- sign-in codes;
- security messages;
- registration confirmations;
- confirmations of a change to, or deletion of, an account;
- confirmation of the permanent termination of a profile and the blocking of re-registration in the case of a serious breach;
- notices of changes to the Terms of Service, the Privacy, Cookies and Technologies Policy and/or the Community Guidelines;
- moderation messages;
- technical messages about the application.
23.2. These messages are not marketing messages; accordingly, opting out of marketing does not stop service messages.
24. Marketing and commercial communications
24.1. We will send you marketing emails, promotions, offers or useful content only if you have given the relevant consent in advance. You may withdraw your marketing consent at any time through: the application settings; an unsubscribe link; or an email to us. For the full terms, see the Privacy, Cookies and Technologies Policy.
24.2. Marketing messages will be clearly identifiable as such. Every marketing message states that it has been sent by Lazy Mama Ltd. or on behalf of SocialMama. Every marketing email includes a way to unsubscribe.
24.3. If we run a prize game, promotion, campaign, giveaway or referral programme, the terms will be clearly set out separately. Apple, Google, the App Store and Google Play are not sponsors of, and do not take part in, our promotions, prize games or campaigns, unless expressly stated otherwise.
25. Analytics and improving the application
We may use data about how the application is used in order to understand which features work well, where there are errors, and how to improve SocialMama. Where analytics is not necessary for the core functioning of the application and is linked to your profile or identifier, we will ask for separate consent. If you decline analytics, you can still use the core features of the application. You can change your choice from the application settings. Details are set out in the Privacy, Cookies and Technologies Policy.
26. Device permissions
26.1. For certain features, SocialMama may request access to functions or information on your device. We will tell you why we are requesting the relevant permission. This may include: location; camera or photos, for your profile photo, posts and/or private messages; microphone, for voice messages; push notifications; device data necessary for the security and operation of the application; local storage of settings; sign-in tokens; analytics technologies, if you have given consent.
26.2. Where a permission is not necessary for a core function, you may refuse it. If you refuse a permission, certain features may not work (for example: without the microphone you will not be able to send voice messages; without a photo you cannot register in the application or use the relevant feature in posts and private messages; without push notifications you will not receive notifications on your device).
26.3. You can manage permissions through your device settings and/or the application settings.
27. Prohibited use
27.1. You may not use SocialMama for: unlawful purposes; harassment; threats; discrimination; sexual harassment; fraud; spam; collecting other users’ personal data; scraping; automated bots; fake profiles; impersonating another person; publishing other people’s photographs without permission; publishing data about children without the right to do so; commercial offers without our permission; political campaigning, where this breaches the Community Guidelines; circumventing technical restrictions; attempting unauthorised access; uploading malicious code; publishing links to sites that distribute malicious software or that are used for phishing or other fraud.
27.2. You may not use SocialMama in a way that harms the application, its users, the reputation of the community or the security of the service.
28. User content and rights in it
28.1. You retain your rights in the content you publish or send through SocialMama. You warrant that you are entitled to publish the content you upload. If your content infringes the rights of third parties, you are responsible for this.
28.2. When you publish or send content, you grant us a limited right to use the content in respect of which you hold rights under clause 28.1, to the extent necessary for the operation of the application. This right includes the ability to: store the content; display the content to other users in accordance with the selected feature; transmit the content technically; process the content for security and moderation purposes; hide or remove content in the event of a breach; and retain evidence of a breach, where necessary.
28.3. The licence under this section is non-exclusive; royalty-free; applicable only for the purposes of SocialMama; and limited to the period necessary to provide the service or to protect rights.
29. SocialMama’s rights in the application
29.1. SocialMama, including its code, design, structure, interface, database, logo, name, trade signs, texts, copyright-protected written materials, graphics and functionalities, is the property of Lazy Mama Ltd. or of the relevant rights holders.
29.2. We grant you a personal, limited, non-exclusive, non-transferable and revocable right to use the application as a user, in accordance with these Terms of Service.
29.3. You may not: copy the application; modify the application; decompile or analyse the code; create derivative products; use the SocialMama trade mark without permission; use the application for a competing service through scraping or unauthorised data extraction; carry out reverse engineering, disassembly or extraction of the source code in any way, except to the extent expressly permitted by law; circumvent or remove technical measures for protection, authentication, licensing or access control; use bots, scripts, robots or other automated means to access the application or to create profiles; overload, disrupt or interfere with the operation of the servers, networks or infrastructure (including DDoS, penetration or load testing without written permission); gain unauthorised access to profiles, data, servers or non-public parts of the application, or scan for vulnerabilities; introduce viruses, malicious code or other harmful software; rent out, sublicense, license, sell, distribute, frame or mirror the application; remove or alter copyright, trade mark or ownership notices; or use the application’s API outside the permitted terms and limitations.
30. External providers and app stores
30.1. SocialMama may use external providers for hosting, databases, analytics, emails, notifications, storage, security and other technical services. Details of these providers are set out in the Privacy, Cookies and Technologies Policy.
30.2. SocialMama is distributed through the App Store, Google Play or other permitted channels. Apple and Google are not parties to these Terms of Service. When downloading, updating, paying for or managing a subscription, the rules of the App Store or Google Play may also apply.
30.3. You must use a compatible device, operating system and internet connection in order to be able to use the SocialMama application.
30.4. We may discontinue support for older versions of the application or operating systems, where this is necessary for security, functionality or app store rules.
31. Prices, paid features and subscriptions
As at the date of these Terms of Service, SocialMama is provided free of charge, unless otherwise stated in the application. If we introduce paid features, subscriptions or in-app purchases, we will give you clear information before purchase, including: what you receive; the price; taxes and fees; the subscription period; whether the subscription renews automatically; how it is cancelled; whether payment is made through the App Store, Google Play or another permitted method; and whether a right of withdrawal applies and on what conditions. If a paid feature is unlocked in the mobile application and the rules of the relevant store require this, payment will be made through the in-app purchase mechanism. For subscriptions taken out through the App Store or Google Play, cancellation, renewal and refunds may be managed by the relevant store. We will not charge you without you first having clearly confirmed that the action creates a payment obligation.
32. Referral programmes, invitations and campaigns
32.1. SocialMama may allow you to invite a friend by sharing a link.
32.2. You must not use the invitation feature for spam or unsolicited messages.
32.3. If invitations, referrals or campaigns involve rewards, bonuses or prizes, we will publish separate terms. The campaign terms will state at least: the organiser; the period; eligibility to participate; the prize; the criteria; the limitations; how the prize is received; and whether Apple or Google are participating — as a rule, they are not.
33. Protection of personal data
33.1. Lazy Mama Ltd. is the controller of personal data for the core processing operations relating to SocialMama. Detailed information on the processing of personal data is set out in the Privacy, Cookies and Technologies Policy, which includes information on: the categories of data; the purposes; the legal bases; pregnancy data; data about children; location; photographs; chat; posts; analytics; marketing; push notifications; providers; international transfers; retention periods; your rights; how to exercise your rights; and complaints to the Commission for Personal Data Protection.
33.2. Accepting these Terms of Service does not constitute consent to marketing, analytics, biometrics or the processing of special categories of data. Where a given processing operation requires consent, we will ask you for separate consent. You may withdraw consent through the application settings or another indicated method. You may exercise your data protection rights via info@socialmama.app.
34. Deleting your account
34.1. You can delete your account from the application via Profile → Settings → Delete account, where this feature is available. Deletion is irreversible! In the future, as new capabilities are developed in the application, we may ask for additional confirmation, for example through: an email code; re-authentication; or another security mechanism.
34.2. Before deletion, we will show you information about what will be deleted and what may be retained for a limited period. We may offer you a short questionnaire, which is optional to complete for the purposes of deleting your profile, through which we seek to understand why you are leaving and how to improve the service that SocialMama offers. Data from such a questionnaire is retained in anonymised form after your profile has been successfully deleted.
34.3. Following a deletion request, the profile may be deactivated immediately. Once deactivated, the deletion of the profile is irreversible.
34.4. Data in active systems is deleted or anonymised within up to 30 days, unless longer retention is necessary for: a legal obligation; defence against claims; security; evidencing consents and withdrawals; preventing abuse; or technical backups, until they are overwritten. During this period, the data referred to in this clause is not used for marketing, analytics, profile recommendations or active features.
34.5. After deletion, we may retain minimal records where this is necessary, such as: logs of registration and of acceptance of the Terms of Service, the Privacy Policy (including cookies and technologies), the Community Guidelines and/or other documents; logs of the user’s initial and subsequent preferences (analytics and/or marketing); a record of the marketing opt-out; a record of the analytics opt-out; security logs; a SHA-256 email hash, serving to prevent re-registration by users whose profiles have been permanently terminated; a log of the deletion; the content of private messages between you and other users in text, voice and photo format, owing to the functional needs of the application (two-way communication and the other party’s ability to retain the content of her own private messages); a name and user content (user-created posts and answers to posts — whether your own or those of others), which are retained for moderation purposes, since they have been the subject of moderation actions such as review, assessment and the imposition of a corresponding moderation measure under these Terms and our privacy and Community policies (the purpose being evidential in the event of a dispute with the user); logs of the deletion of your data at external providers, where they provide such logs; the anonymised answers to the optional exit questionnaire; and data that the law requires us to retain.
34.6. Uninstalling the application from your device does not automatically delete your account. To delete your account, use the function in the application or contact us at info@socialmama.app.
35. Termination by you
You may stop using SocialMama at any time. This can be done by: signing out of your profile; deleting your account; or uninstalling the application. If SocialMama offers subscription plans and you have an active subscription through the App Store or Google Play, you must cancel it through the relevant store, unless otherwise stated in the application.
36. Restriction or termination by SocialMama
We may restrict, suspend or terminate your access to SocialMama if: you breach these Terms of Service, the Privacy, Cookies and Technologies Policy and/or the Community Guidelines; you create a fake profile; you use another person’s identity; you endanger another user; you publish prohibited content; you abuse the application; you attempt a technical attack; you breach the legislation of the Republic of Bulgaria or the European Union; this is necessary for the security of the application; or this is required by a competent authority. Where it is possible and safe to do so, we will inform you of the reason. Where there is serious risk, we may act immediately. If you believe the measure is incorrect, you may submit an objection to info@socialmama.app.
37. Availability and changes to the application
We make reasonable efforts to keep SocialMama running stably and securely. We do not guarantee that the application will be available without interruption, without errors or without technical limitations. We may temporarily restrict access for: maintenance; updates; error correction; security; infrastructure changes; an App Store or Google Play requirement; or a legal requirement. We may add, change or remove features where this is necessary for the development, security or compliance of the application. If a change is material to the contract, we will notify you.
38. Conformity of the digital service and consumer rights
38.1. If you use SocialMama as a consumer, you have all the rights that the law grants to consumers.
38.2. Nothing in these Terms of Service limits rights that cannot be limited by law.
38.3. SocialMama must conform to the description, the functionalities and the reasonable expectations for a digital service of this kind.
38.4. If we introduce paid features, we will provide the additional pre-contractual information required by law.
38.5. If you believe that the service does not conform to the contract, you can contact us at info@socialmama.app.
39. Limitation of liability
SocialMama is a social platform. We are not liable for any act, omission, statement or content of users. We are likewise not liable for: in-person meetings between users; decisions taken on the basis of user content; medical or parenting advice given by users; content published by users; harm arising from your opening a link published by another user; harm arising from improper use of the application; inability to access the service due to your device, internet connection or operating system; or acts of the App Store, Google Play or third-party providers outside our control. This limitation does not apply where the law does not permit liability to be limited. We do not exclude liability for wilful misconduct, gross negligence or breach of mandatory consumer rights.
40. Security
40.1. We apply technical and organisational measures to protect SocialMama and the data within the application. Such measures may include: access control; encryption; security logs; restricted team access; database protection; incident procedures; and the review of reports and abuse.
40.2. You must also protect your profile, your device and your email. If you use a shared device, you should bear in mind that other persons may gain access to the application if the device is not secured. SocialMama may keep you signed in to your profile until you select “Log out”, delete your account, or the session is terminated for security reasons.

41.1. You can contact us regarding: a technical problem; a question about your profile; a report of a breach; an objection to moderation; a question about the Terms of Service; a question about personal data; cases of breaches under clause 36 of these Terms of Service; and the submission and handling of a complaint, at the following contact details:

41.2. If you are a consumer, you may also submit a complaint to the Commission for Consumer Protection, where the dispute falls within its competence. The Commission’s contact details are: 0700 11 122, info@kzp.bg, Sofia, 1 Vrabcha Street.
41.3. For questions concerning personal data, you can use the contact details set out in the Privacy, Cookies and Technologies Policy.
42. Changes to the Terms of Service
42.1. We may change these Terms of Service. Reasons for a change may include: new features; changes to the application; changes in the law; App Store or Google Play requirements; security measures; changes in the way moderation is carried out; the introduction of paid features; changes to the Community Guidelines; or changes of providers or infrastructure. We will notify you of changes through: a message in the application; email; a push notification; or another appropriate electronic means. Where the law requires it, we will notify you within the prescribed period.
42.2. In the case of material changes, we may request fresh express acceptance. If you do not agree with a change, you may stop using the application and delete your account. Where applicable consumer law gives you the right to refuse a change and continue on the previous terms, that right applies to the extent provided by law.
42.3. Changes required by law, by a competent authority, by the App Store, by Google Play, or by an immediate security risk may take effect immediately, where this is necessary.
42.4. Earlier versions of the Terms of Service may be archived and made available to users.
43. Governing law and disputes
These Terms of Service are governed by the law of the Republic of Bulgaria. If you are a consumer and the law of your country of habitual residence affords you more favourable protection, these Terms of Service do not limit that protection.
Disputes are resolved by mutual agreement wherever possible. If a dispute is not resolved amicably, it shall be referred to the competent court or authority in accordance with the applicable law.
44. External code of conduct
44.1. As at the date of these Terms of Service, Lazy Mama Ltd. has not subscribed to any external code of good commercial practice, unless expressly stated otherwise.
44.2. The Community Guidelines are an internal SocialMama document and form part of the contractual framework between you and Lazy Mama Ltd.
45. Final provisions
45.1. If an individual clause of these Terms of Service is found to be invalid, this does not affect the remaining clauses. The invalid clause is replaced by the applicable rule of law or by a valid clause that most closely reflects the purpose of the original clause. Headings are for convenience only and do not affect interpretation.
45.2. These Terms of Service take effect from the date stated at the beginning.
